Terms & Conditions

1. Introduction

Noouri GmbH ("Noouri"; hereinafter also "us", "we", "our") offers advisory services, online tools and courses in the field of child nutrition. By using and availing yourself of our services (as defined below), you (hereinafter also "client", "clients") agree to the following General Terms and Conditions. Please read them carefully.

2. Our Services

Noouri GmbH ("Noouri"; hereinafter also "us", "we", "our") offers advisory services, online tools and courses in the field of child nutrition. By using and availing yourself of our services (as defined below), you (hereinafter also" client", "clients") agree to the following General Terms and Conditions. Please read themcarefully. Noouri offers in particular the following services in the area of nutrition and lifestyle coaching for children aged 0 to 6 years, with a special focus on the introduction of complementary feeding (together the "Services"):

  • Preventative individual coaching (online and offline);
  • Online courses, seminars and workshops (online and offline);
  • Provision of useful information and tools via software applications (e.g. apps including recipe apps and chatbots) and digital platforms.

The Services are aimed at families and individuals who wish to receive preventive support with regard to child nutrition. We offer our services in particular in the form of coaching sessions, apps and community platforms.

IMPORTANT NOTICE REGARDING OUR SERVICES: THE SERVICES OFFERED BYNOOURI ARE EXCLUSIVELY FOR PREVENTIVE AND EDUCATIONAL PURPOSESAND ARE DIRECTED EXCLUSIVELY AT HEALTHY INDIVIDUALS. NOOURI DOESNOT PROVIDE MEDICAL DIAGNOSES FOR CHILDREN OR ADULTS, DOES NOTCARRY OUT TREATMENTS, AND DOES NOT PROVIDE CARE IN MEDICALEMERGENCIES. THE SERVICES DO NOT IN ANY WAY REPLACE MEDICALADVICE OR TREATMENT. NOOURI ALSO RESERVES THE RIGHT TO REFUSETHE PROVISION OF CERTAIN OR ALL SERVICES WITHOUT GIVING REASONS.

The duration, costs and specific scope of our services are determined by the individual offer from Noouri (as indicated, for example, on the website or as individually agreed).

Our services are provided, depending on the agreement, at the premises of Noouri or third parties, at clients' homes, or in digital or online form. The determination of the place ofservice delivery is at the sole discretion of Noouri. However, we endeavour to take our clients' preferences into account.

3. Exclusion of Liability and Responsibility

The liability of Noouri and its vicarious agents for both direct and indirect damages arising from the contract with clients is excluded to the extent permitted by law. This exclusion of liability applies regardless of the legal basis. This also applies with regard to the implementation of recommendations (e.g. preparation of meals, introduction of new foods),which is the sole responsibility of the clients. The duty of supervision over the child lies at no time with Noouri, but at all times and in full with the clients.

Noouri does not guarantee success with regard to its services (e.g. a change in the child's behaviour or acceptance of certain foods). The use of the services is at the client's own risk and responsibility. Noouri assumes no responsibility for the accuracy, completeness or timeliness of the information provided in chatbots, apps or courses. For services provided online, apps or platforms, Noouri may use third-party software applications. The use of such software applications may require you to accept the terms of use of the respective third-party provider. Noouri excludes any liability for the functionality or quality of third-party software applications.

4. Bookings, Cancellations and No-Shows

Bookings and cancellations of our services can be made via our booking system, by telephone or by email. Appointments are only considered confirmed once they have been confirmed by Noouri.

Agreed appointments can be cancelled up to 24 hours before the appointment at the latest. In the case of later cancellations or no-shows, the appointments will in principle be charged.

5. Invoicing and Late Payment

Invoices from Noouri are to be settled within a payment period of ten (10) days (unless otherwise stated on the respective invoice). If payment is not made within the payment period, default in payment occurs automatically without any reminder, and Noouri is entitled to charge default interest of 5% p.a. without further notice. Clients must additionally bear reminder costs of CHF 15.00 per reminder. After three unsuccessful reminders, we are entitled to hand over the case to our debt collection partner, who will initiate enforcement proceedings on our behalf and enforce the claims.

Noouri reserves the right to refuse the provision of further services in the event of late payment.

6. Cost Contributions

The services of Noouri are in principle to be paid for privately. Clients are themselves responsible for clarifying any cost contributions from (supplementary) insurance and for taking the necessary steps in this regard. Noouri is not obliged to seek accreditation with an insurer or other competent authority for the purpose of obtaining cost contributions.

7. Applicable Law and Jurisdiction

These GTC are governed by Swiss substantive law, in particular the Swiss Code of Obligations. All disputes arising in connection with our services are, in principle and to the extent permitted, subject to the exclusive jurisdiction of the courts at the registered seat of Noouri. Noouri is also entitled, at its own free discretion, to bring proceedings before the ordinary courts at the client's place of domicile.

8. Amendments to these GTC

Noouri reserves the right to amend these GTC at any time and without giving reasons. For existing contractual relationships, Noouri will, where still relevant, notify clients of such changes in an appropriate manner with a notice period of at least 20 days. Without objection within this period, the amendments shall be deemed accepted by the client.
